Effective October 9, 2026 · Version 1.0
PLEASE READ CAREFULLY. THIS IS A LEGAL AGREEMENT. BY ACCEPTING IT, YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE PUMPS & PIROUETTES FOR INJURIES CAUSED BY ITS NEGLIGENCE.
We are an adults-only studio built for dancers at every level. We take your safety seriously, and we ask you to take responsibility for your part of it. This Agreement explains the risks of dance, what we expect of you, and the rights you give up by participating.
Definitions
- “Pumps & Pirouettes,” “the Studio,” “we” and “us” mean Pumps & Pirouettes, LLC.
- “Released Parties” means Pumps & Pirouettes, LLC and its owners, members, managers, employees, instructors and choreographers (whether employees or independent contractors), staff, volunteers, agents, successors and assigns.
- “Activities” means every class, pop-up, workshop, private lesson, rehearsal, Performance Program, filming session, performance, showcase, open-studio or practice time, member event and any other program we offer, at the Studio or at any off-site location we organize. It includes warm-up, cool-down and time spent on the premises before and after.
- “I,” “me” and “my” mean the person accepting this Agreement.
1. Adults only
I confirm that I am at least 18 years old. Pumps & Pirouettes is an adults-only studio. The Studio may ask for proof of age, and anyone under 18 may not participate.
2. Voluntary participation
My participation is entirely voluntary. I choose which Activities to join, and I may stop, rest or modify any movement at any time.
3. The nature of dance and its risks
Dance is a physical activity with real risks. Those risks exist even when instructors are careful, the space is well kept and I follow every instruction. They include, without limitation:
- Dancing in high heels: loss of balance, falls, and sprained, strained or broken ankles, feet and knees.
- Floorwork: stress on knees, hips, wrists and spine, plus bruising, friction burns and impact with the floor.
- Partner and group work: contact with other dancers, shared weight, and collisions or falls caused by others.
- Physical exertion: muscle and joint injuries, overuse injuries, dehydration, fainting, heart or breathing problems, and illnesses spread by close contact with others.
- The studio environment: mirrors, walls, barres, chairs, mats, props, sound equipment, stairs and floor surfaces that may be slippery.
- The pace of instruction: choreography and technique that become more demanding, and instruction or physical cues that may not suit my body.
Injuries can range from minor to serious, including permanent disability, paralysis and death.
4. Assumption of risk
I understand these risks. I knowingly and voluntarily assume all of them, both known and unknown, including risks arising from the negligence of the Released Parties, and I accept responsibility for any injury, illness, loss or damage that results.
5. My health and my responsibilities
- I am in good enough health to participate. I have consulted a physician about any condition that could be affected by dance, including pregnancy, recent injury or surgery, heart, joint or breathing conditions, and any medication that affects balance or alertness.
- I will tell my instructor, before class, about any injury, limitation or condition they should know about.
- I will listen to my body. I will modify, rest or stop when I feel pain, dizziness or shortness of breath, and I will report any injury to staff right away. I will stay home when I am sick or contagious.
- I am responsible for my own footwear, including choosing heels that fit securely and that I can control.
- I will not participate under the influence of alcohol, cannabis or any substance that impairs my judgment or coordination.
- The Studio does not provide medical advice. Instructors are not medical professionals, and no Released Party has assessed my fitness to dance.
6. Release of liability and promise not to sue
IN EXCHANGE FOR BEING ALLOWED TO PARTICIPATE, I, FOR MYSELF AND FOR MY HEIRS, EXECUTORS, ADMINISTRATORS AND ASSIGNS, RELEASE, WAIVE AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES AND LIABILITY FOR PERSONAL INJURY, ILLNESS, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES OR MY PRESENCE AT THE STUDIO, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES.
I PROMISE NOT TO SUE ANY RELEASED PARTY FOR ANY CLAIM I HAVE RELEASED.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct by a Released Party, or to any claim that New Hampshire law does not allow to be released.
7. Indemnification
I agree to indemnify, defend and hold harmless the Released Parties from any claims, losses, damages and costs, including reasonable attorneys’ fees, brought by any other person and arising from (a) my conduct at the Studio or during the Activities, (b) my breach of this Agreement, or (c) any claim I have released that is brought on my behalf.
8. Emergency medical treatment
If I am injured or become ill and cannot consent for myself, I authorize the Released Parties to provide or arrange first aid, call emergency services, and arrange transport to a medical facility. They have no obligation to do so. I am responsible for all costs of any medical care, transport or treatment I receive.
9. Personal property
The Studio is not responsible for lost, stolen or damaged personal belongings, including shoes, clothing, phones, jewelry, bags and vehicles. I bring personal property to the Studio at my own risk.
10. Studio rules and conduct
Pumps & Pirouettes is a space where adults can dance boldly and feel safe doing it. I agree to:
- Follow instructor and staff directions, and dance within my own ability.
- Treat every dancer, instructor and staff member with respect. Harassment, discrimination, and unwanted touching or comments are not tolerated.
- Respect that instructors may offer hands-on corrections. They will ask first, and I may always say no.
- Keep street shoes off the dance floor. Only clean, studio-only footwear, socks or bare feet are allowed there.
- Not smoke, vape or use open flames anywhere in the building.
- Not record or post other participants without their permission, and record class content only when the instructor allows it.
The Studio may refuse entry to, or remove, anyone whose behavior is unsafe, disruptive or disrespectful. Refunds and credits in that case are governed by the Terms of Service.
11. Photo, video and media release
Classes, filmed combinations, rehearsals, performances and events are often photographed and filmed. Unless I opt out as described below, I grant Pumps & Pirouettes a non-exclusive, royalty-free, worldwide, perpetual right to record, use and share my name, image, likeness, voice and performance in photos, video and audio taken during the Activities. This includes use on the Studio’s website, app, social media, advertising and promotional materials. I will not be paid for this use, and I waive any right to approve the final content.
How to opt out: Email info@pumpsnpirouettes.com with the subject line “Media Opt-Out,” and tell your instructor at the start of each class or event. We will make reasonable efforts to keep you out of filmed and photographed content and will not feature you in Studio marketing. You may still appear incidentally in the background of group content. We will remove content in which you are clearly identifiable from Studio-controlled accounts on request, but we cannot recall content already shared by others.
Performance Programs may require filming. Media terms for those programs are set out in the Performance Program Agreement.
12. Guests and Bring-a-Friend participants
Every participant, including guests on a Guest Pass or Bring-a-Friend invitation, must create their own account and accept this Agreement before participating. A member may not accept this Agreement on a guest’s behalf.
13. Other agreements
Some Activities have additional written terms, such as the Performance Program Agreement. Those terms add to this Agreement. If they conflict on a matter of liability or risk, the terms that give the Released Parties greater protection apply.
14. Electronic signature and records
I agree to sign this Agreement electronically. Checking the acceptance box and submitting it through the Studio’s website or app is my legal signature and has the same effect as a handwritten one, under the federal E-SIGN Act and New Hampshire’s Uniform Electronic Transactions Act (RSA 294-E).
The Studio will keep an electronic record of my acceptance, including my name, account, the date and time, and the version I accepted. I may request a copy at any time by emailing info@pumpsnpirouettes.com. If I withdraw my consent to electronic records, I must sign a paper copy before I participate again.
15. How long this applies, and updates
This Agreement covers all of my participation, now and in the future, until I accept an updated version. The Studio may update it and will ask me to accept the new version before my next booking or visit.
16. Related policies
This Agreement works alongside the Studio’s Terms of Service (bookings, payments, cancellations, memberships and refunds) and Privacy Policy (how my information, including health and injury information I share, is collected, used and protected).
17. Governing law, severability and entire agreement
This Agreement is governed by the laws of the State of New Hampshire. Any dispute will be brought only in the state or federal courts located in Hillsborough County, New Hampshire.
This Agreement is intended to be as broad and inclusive as New Hampshire law allows. If any part is found unenforceable, that part will be limited to the extent necessary, and the rest will remain in full effect.
This Agreement, together with the documents referenced in it, is the entire agreement between me and the Studio on the subjects it covers. No verbal statement by any Released Party changes it.
18. Acknowledgment and signature
BY CHECKING THE ACCEPTANCE BOX IN THE APP OR BOOKING SITE, I CONFIRM THAT:
- I am at least 18 years old.
- I have read this entire Agreement and had the chance to ask questions about it.
- I understand that I am giving up substantial legal rights, including my right to sue the Released Parties for injuries caused by their negligence.
- I am accepting it freely and voluntarily, and I intend my electronic acceptance to be my signature.
